Terms of Service

Welcome to MapMarked. These Terms of Service ("Terms") govern your use of the MapMarked website and services (the "Service"). By creating an account or using the Service, you agree to these Terms. If you don't agree, please don't use the Service.
Please read these Terms alongside our Privacy Policy, which explains how we handle your information.
1. What MapMarked Does
MapMarked lets you generate custom, print-ready map art for any address, city, or landmark, using map data from OpenStreetMap. You choose a location and a color palette, and we render a downloadable image you can print or use.
2. Pricing & Payment
You can preview any map at no cost — it renders with a watermark. To remove the watermark and receive the print-ready, high-resolution (300 DPI) file, you choose one of the following:
- Single map — a one-time fee of $6.99 per map ($9.99 for a map using a premium palette). Grants a personal-use license (Section 5). No subscription required.
- Creator membership — $19.99 per month, including 10 map downloads per month with a commercial license (Section 5). Additional downloads beyond the monthly allowance are billed at $2 per map.
- Studio membership — $50 per month, including 50 map downloads per month with a commercial license plus additional Studio tools. Additional downloads beyond the monthly allowance are billed at $1 per map.
Memberships are recurring subscriptions that renew automatically each month until cancelled. You may cancel anytime and keep access through the end of the current billing period. Monthly download allowances reset each billing period and do not roll over. Membership availability may be introduced in phases.
Payments are processed by Stripe. Because downloads are digital goods delivered instantly, single-map purchases and per-map overage charges are final and non-refundable once the file has been generated and sent, and subscription fees already charged are non-refundable. If something goes wrong with an order — for example, you don't receive your download — email steve@mapmarked.com and we'll make it right.
3. Accounts
To download maps, you need to create an account with a valid email address. You are responsible for:
- Keeping your login credentials secure
- All activity that happens under your account
- Providing accurate information when you sign up
You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account. The Service is not directed at children.
We may suspend or terminate accounts that violate these Terms, abuse the Service, or attempt to circumvent usage limits.
4. Usage Limits
Watermarked previews are unlimited and free. Clean (unwatermarked) downloads are governed by your plan: a single-map purchase entitles you to that one map, while a membership includes a monthly download allowance (10 per month for Creator, 50 per month for Studio) that resets each billing period and does not roll over. Downloads beyond your monthly allowance are billed at the per-map overage rate for your plan (Section 2).
Attempting to bypass these limits — for example, by creating multiple accounts to exceed an allowance, or by automating requests — is not permitted and may result in account termination. We may adjust plan limits and pricing on a going-forward basis.
5. Your License to Use the Maps
The license granted with each map depends on how it was obtained, and is subject to these Terms and the OpenStreetMap data license in Section 6:
- Single map ($6 / $9) — a personal-use license. You may print, display, and use the map for your own personal, non-commercial purposes. You may not sell, license, or commercially distribute maps obtained under a single-map purchase.
- Commercial membership ($20/mo or $200/yr) — a commercial license for each map you download while your membership is active. You may print, display, sell, and distribute physical or digital copies of those maps, including in products you sell.
Buying a single map does not let you sell it. A $6 (or $9 for your own custom colors) purchase is for personal use — print it, frame it, hang it, or give it as a gift. It does not include the right to sell it or list it for sale anywhere. Selling maps, on Etsy or anywhere else, requires a Commercial membership; if you plan to list your maps, start with a membership rather than a single purchase.
Commercial rights survive cancellation for maps you already downloaded while entitled. If you cancel a membership, the commercial license for maps you downloaded during your active membership remains in effect. You do, however, lose access to new downloads and membership tools, and no commercial license attaches to any map not downloaded while your membership was active. We keep a record of your downloads and the plan in effect at the time as proof of the license granted.
Branded (white-label) output — Commercial members
A Commercial membership lets you replace the "MapMarked" brand line in the corner of the map with your own text — for example, a name or business such as "Jane Doe Realty." This is a text label, not an uploaded logo or image: you type the line, and it is set in the same type as the rest of the map. You may print, display, distribute, and give the resulting branded files to your own clients or customers as part of your business.
The OpenStreetMap attribution must remain on every file. Replacing the brand line removes only the MapMarked name — it never removes the "© OpenStreetMap contributors" credit, which the map data license requires and which you may not remove or obscure (see Section 6).
Selling the finished maps you create is exactly what the commercial license is for. You may sell them as physical prints or as digital-download files — including on marketplaces like Etsy — and the customer who buys one may print what they bought. What the license does not allow is reselling the maps as a stock or clip-art library, bundling them into design-asset or template packs for others to reproduce at scale, or reselling access to the map-generation tool itself. In short: sell the maps you make; don't resell the map-making.
Branded files you have already created stay licensed permanently, even after you cancel. Every branded file you created and downloaded while your membership was active remains fully licensed — you may keep using, distributing, and displaying it forever. Cancelling only stops you from creating new maps; it never revokes the license on maps you already made. Files you have already delivered to clients, and listings you have already posted, do not become unlicensed because you cancelled.
Your saved corner-label text stays on your account after you cancel — we do not delete it. The white-label replacement of the brand line, however, requires an active membership: without one, if your label appears on a personal single-map purchase it is appended alongside the "MapMarked + OpenStreetMap contributors" credit rather than replacing it. If you resubscribe, the replacement resumes automatically with your saved label — there is nothing to re-enter.
Under any license, you may not:
- Remove or obscure the attribution embedded in the map (see Section 6)
- Resell the maps as a stock or clip-art library, as template or design-asset packs for others to reproduce at scale, or resell access to the map-generation tool itself (selling the finished maps you make — as prints or digital downloads — is permitted under a commercial license; see above)
- Use the maps in any unlawful way or in a way that infringes the rights of others
We do not claim ownership of the specific maps you generate. You are responsible for ensuring your use of any address or location does not violate anyone's privacy or other rights.
6. Map Data and Attribution
Map data is © OpenStreetMap contributors and is made available under the Open Database License (ODbL). Every map rendered by MapMarked includes attribution to OpenStreetMap contributors and to MapMarked.
You may not remove this attribution. It is required by the OpenStreetMap data license and by these Terms. If you reproduce or display a MapMarked map, the attribution must remain visible.

7. Acceptable Use
You agree not to:
- Use the Service for any illegal purpose
- Attempt to gain unauthorized access to the Service, other accounts, or our systems
- Interfere with or disrupt the Service, including through automated scraping, bots, or excessive requests
- Use the Service to generate, distribute, or facilitate harmful, harassing, defamatory, or infringing content
- Reverse engineer, copy, or create a competing service from the Service or its underlying technology
8. Intellectual Property
The MapMarked name, logo, website design, software, and the look and feel of the Service are owned by us and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks or branding except as needed to use the Service normally.
9. Service Availability
We provide the Service "as is" and "as available." We do our best to keep it running, but we don't guarantee it will be uninterrupted, error-free, or that any particular map will render successfully. We may modify, suspend, or discontinue any part of the Service at any time.
10. Disclaimers
To the fullest extent permitted by law, the Service is provided without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.
Map data comes from OpenStreetMap and may contain errors, omissions, or outdated information. We do not warrant the accuracy or completeness of any map. Do not rely on MapMarked maps for navigation, emergency, legal, surveying, or other purposes requiring verified accuracy.
11. Limitation of Liability
To the fullest extent permitted by law, MapMarked and its operator will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of (or inability to use) the Service.
Our total liability to you for any claim relating to the Service is limited to the greater of (a) the amount you have paid us in the twelve months preceding the claim, or (b) one hundred U.S. dollars ($100).
Some jurisdictions don't allow certain limitations, so some of the above may not apply to you.
12. Indemnification
You agree to indemnify and hold harmless MapMarked and its operator from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of another party.
13. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we'll update the "Last updated" date and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect means you accept the updated Terms.
14. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or for any other reason at our discretion. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and indemnification) will survive.
15. Governing Law
These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict of laws principles. Any disputes will be resolved in the state or federal courts located in Florida, and you consent to their jurisdiction.
